    Alleged BC rave sex assault victim says she's 'devastated' after charges stayed

    PITT MEADOWS, B.C. - A young woman whose life was upended after graphic photos depicting her alleged rape at a British Columbia rave party were spread over the Internet two years ago says she's devastated and repulsed that a sex assault charge in the case has been stayed.

    The teen took the rare step of sitting before cameras on Wednesday to publicly plead for spectators to come forward who have maintained a "code of silence" and held back from telling police what they know and witnessed.

    "No one in their right state of mind, including myself, would let something like that happen to them willingly," the teen told reporters, as her father sat next to her in a small community centre in Pitt Meadows, B.C., a bedroom community east of Vancouver.

    "I've often wondered why women never reported when they were sexually assaulted, and now I know. It's a 'he-said, she-said' thing."

    The teen was 16 years old when she went to the party in the rural area east of Vancouver on Sept. 11, 2010, where police said she was drugged and repeatedly raped while bystanders clicked photographs.

    The images were spread quickly over Facebook, and she was tormented at school.

    Police said some of those photos may never be wiped from social media entirely.

    "To anyone who thinks this is OK, I'd like you to take your mother, girlfriend, wife, sister, niece, daughter — any female you know — and go do this to them. It's wrong and we all know it," said the teen, reading with a steady voice from a prepared statement.

    "Someone with any morals would have never done this, not to mention let people watch and take pictures.

    "It makes me sick even thinking about it."

    The teen cannot be identified by court order, but she appeared at the news conference with her father after they asked police to help them make the plea.

    The father said the extent of injuries his daughter suffered would not have happened in a situation where she was willing.

    He, too, appealed to bystanders who have never shared information with police.

    "You know at some point in your life, you will have to explain to perhaps your own kids ... what's right in life," he said. "It's never too late to do that. This is your time to do what's right."

    Earlier this month, a teenaged boy who posted some of the images online was sentenced to 12 months' probation and ordered to write an apology to the victim.

    Another man, Dennis Warrington, is charged with making and distributing pornography as a result of the attack.

    But the sex assault charge against Colton Ashton McMorris was stayed Tuesday.

    McMorris's lawyer said his client has had his life ruined following publicity around the high-profile case.

    Tony Serka said the effects of the RCMP news conference that referred to the attack as a gang rape will continue for his client if anyone, including potential employers, decides to Google McMorris' name.

    Serka said the stay in court proves McMorris is innocent.

    Neil Mackenzie, spokesman for the Crown, said the stay of proceedings was entered Tuesday after the "experienced prosecutor" on the case conducted a thorough assessment of the evidence.

    "The review included interviewing the numerous potential witnesses," Mackenzie said.

    He said prosecutors didn't think there was enough evidence to get a conviction.

    The Crown has one year to gather more evidence and re-activate the charge.

    Sgt. Peter Thiessen told reporters police still "strongly believe" more than one person was involved, but would not elaborate as to the nature or range of allegations.

    He said police continue to work on the case.

    "I can assure you, knowing the content of these photos, it was not exaggerated what happened to this girl," said Thiessen, who has two daughters.

    "Absolutely not. And I would say that if anybody heard the details of what this girl experienced, we wouldn't be having this conversation."

    The teen said she's certain there is more evidence out there that will yet "make the case a go."

    "I'm asking you to please come forward," she said. "It would mean the world to me and my family."

    The decision to stay the charge sparked outrage from Vancouver Rape Relief and Women's Shelter, which said in a statement it is a betrayal of the woman, who was 16 at the time of the attack.

    "We urge those in the community who witnessed the attack to come forward and tell us what they know," the group said in a news release.

    "'Not enough evidence' means police and Crown failure. We refuse to accept 'the unlikelihood of conviction' as a reason to keep this man from facing justice."

      Perhaps I don't have all the facts but surely DNA obtained from sperm found inside the girl could be matched to the alleged perpetrators right?

        D DNA does not prove rape it proves sex which the photos and the video and the people involved have already admitted to. The problem is the girl says rape the guy says consensual and that she flipped her story after her parents found out, which is supported by the fact the girl did not go to the hospital that night she went the next afternoon after the pictures went viral. It is hard to build a rape case and get a conviction with this type of situation.

        My Opinion - you, like the 'justice' system, are blaming the victim. Obviously, you have never been the victim of a serious crime, otherwise you would understand and have empathy for this young girl. If that is the case, consider yourself very fortunate.

        Most rape victims are afraid to go to the hospital because of guilt or confusion or fear. Working with victims of Rape I have heard many stories as to why it wasn't reported sooner. Reading the story, there was injuries to her body that would indicate rape. We don't need the justice system or anyone else blaming the victim, they do it quite well themselves

        The roomer here sadly enough was that the girl had actually been bragging that night to friends prior to going to the party that she was going to have sex that night. The second part of this rumour is that she was a willing participant bragging to friends she got laid and that she did not go to the hospital or report it until the next day because it was consensual. The last part of the rumour is that she claimed rape after photos were plastered online and her parents found out. It was her only ability to avoid her parent’s wrath, as they were very strict.

        Remember this is just a rumour; I have no clue of any of the actual facts but if this rumour was circulating does show that it would be hard to ensure a conviction when there is even doubt locally that she was raped. Regardless if it was consensual or not it is very sad that it has had such a negative impact on this girl and her family. She lost many friends after this because they were disgusted she claimed rape after her statements earlier in the night and her bragging about it that night to friends that she had achieved her goal. She was harassed and had to change high schools. Life for her has not been easy that is for sure.

        Additionally in the photo's it shows she was smiling in many so very hard to support rape. NOT to say that if she was unwillingly drugged that she might not be aware of what was happening. I personally do not know a persons response to the date rape drug if they would show signs of happiness when they are not.

      So they have enough evidence to convict someone of distributing photos of the rape but not enough evidence to convict the person who did the rape? There is something very wrong with this. I don't have kids but if I were this girls mother, I'd hunt down every person in these photos and/or videos and drag their smug arses right into the cops. Rapist or bystander, they're all at fault for this girl's continued suffering and they should be disgusted with themselves. Not that they are obviously, no respect for themselves, each other or authority.

        They did not convict someone of distributing photo's of a rape they convicted someone of distributing nude/indecent photos of a minor. Which is a big difference. They never charged that person with anything to do with the word or action of rape.

        I live here Hannies Momma, I have children, siblings, friends, and extended family that all live here. I am sharing the other side that is not written be offended and biased all you wish but at least I am open minded to not judge anyone until the evidence is certain they are guilty. I hope one day you never have to be on the accused side if you are innocent as you assume all are guilty soon as there is charges obviously. I personally do not. I personally believe that it is tragic this girl was even at a rave. That this girl was not taught to never take a drink from anyone, not put her drink down, not share a drink to prevent herself from getting raped. I think it is tragic that if this boy was aware that she was under the influence of drugs that he took advantage of that for his own needs at a moment. I think it is horrible the thought that if people were watching and knew she was being raped they did nothing. BUT THE FACT IS there is not enough published evidence to determine that that is what happened. WHY ARE YOU SO POSITIVE THAT THESE GUYS ARE BAD?

      The girl did drugs, and regretted being "caught in the act". Easy enough to cry "rape" rather than suffer the wrath of Mom and Dad. As for the young men who had sex with her - they were also on drugs, in all likelihood. All of them being irresponsible, doing irresponsible things, and they were caught on camera. The lesson here is to not let your kids go to raves. And to teach them better than to take drugs. The people who have responded to this thread jumping to the defense of the girl - the Crown chose not to, and it must have had good reason. "E" and "G" and God only knows what other drugs are out there these days - "T" and "H", and every other letter of the alphabet....they kill people, ruin lives, cause all sorts of heartache. And sometimes, they make people writhe on the floor begging anyone to have sex with them (saw a girl doing just that in a club years ago - something I'll never forget....it was about as primal and feral as I have ever seen a human being get...she was on GHB). Where is the proof she was "drugged" and not that she "took drugs"? Where is the proof she was assaulted and not consensual? Young and stupid, yes there is proof of that, but not much else, I would suspect, or the Crown would have rallied to her defense. The "witnesses" who have not "come forward" likely have not because they do not agree with her version of events - possibly for good reason, and they do not want to be identified as participating in a social event where drugs are prevalent (a stigma they choose to avoid being tagged with). I have to call this one a red herring... a middle class girl who was filmed drugged out having sex, whose misadventure went viral and came home to roost.

      Lets see, we have pictures and videos of the assault, we can plainly see the perpetrators, we have the statements of numerous witnesses. Nope, not enough evidence, stay the case and let some rapists walk free. Hopefully, some time in the future some semblance of sanity and justice will somehow return to the Canadian justice system as it is evident that sanity and justice is sorely missing.
      There is no doubt that those who participated in this assault will one day again appear before our courts under similar circumstances.

      Everybody who saw the tape confirmed that there was no forced sex at all. She was a willing partner and she want to do as many boys as possible. The problem is that she was not 19 years old at that time and most boys were between 16-21! Now the age of consent is 16 so does this legally qualify as a rape or just young kids messing around? We can assume that the girl was a victim, somehow got drugged and never wanted to have sex. But then, if the girls was raped, how come she never, even onces, said "NO" or "STOP"!
      The most logical explanation is that she was a wilfull partner in crime and she is now cleaning up her act.......even if she has to destroy the life of 10-20 boys!
      But the law is blind!..........we have to see all evidence(s) (like DNA from sperm)............or simple dismiss the case!

      Colton's life has been destroyed by the bad publicity - GOOD! I hope his life continues to be destroyed - that's what you get when you drug and gangbang an underage girl. Appalling that the charges have been stayed. What foolish teens today - none will come forward as witnesses - probably "too cool" for that - hope they are next then.
