Judge dismisses $15M lawsuit against city

An Ontario Superior Court judge has dismissed a $15 million lawsuit against the City of Ottawa from a contractor that tried to bid for work at the Robert O. Pickard Environmental Centre.

Hervé Pomerleau Ontario Inc. sued the city for alleged breach of contract in relation to a 2005 bid the company submitted for the construction of concrete digester tanks at the waste-water treatment plant.

The lawsuit alleged the city shouldn't have rejected the bid over issues of non-compliance from one of its sub-contractors.

In a note to councillors, city solicitor Rick O'Connor said Justice Albert Roy issued an oral decision dismissing the lawsuit against the City in its entirety.

Pomerleau has 30 days in which to appeal the decision to the Ontario Court of Appeal, O'Connor noted.
