    Real Jerk heads to court

    A popular Toronto restaurateur will be in court on Tuesday, instead of in the kitchen.

    Ed Pottinger and his wife Lily have hired a lawyer to fight an eviction notice for the Real Jerk, which has been a fixture at the corner of Queen and Broadview for more than 20 years.

    On Monday night the Real Jerk served up what could be the last meals at its current location.

    For Caroline Winship it was a sad night. After 15 years as a regular, there's nowhere else she would rather be.

    "It's like family and a community here. Ed and Lilly ... are so generous and the staff have been here for as long as I've been going here," said Winship.

    The Real Jerk was given an eviction notice over the Christmas holidays.

    Restaurant manager Natalie Williams said they were given "31 days to pack up and get out. It's unfair and not neighbourly."

    The restaurant owners will ask the court to give them some more time so they can find a new location.

    "If we were given extra time by the injunction, that's what we're going to focus on .... give us the breathing room to check out this location, check out that location."

      Nothing was stated in this article about WHY these people are being evicted from their restaurant..It would be nice is everything was put in the article..Is the building being torn down..Is the restaurant dirty, No one has stated What or Why..After 20 years there has to be a very good reason..Your would think

      That's the problem with leasing., You fix the Place and when the lease comes up for renewal, The New rent matches the Value you've put into the place, And you are stuck with; "you can leave or pay more". It's a dog eat dod world, where fairness DOES NOT COUNT For Anything by the Greedy, Just the bottom line. Hope they add a few words to the sign before leaving; like "My Landlord is" What goes around comes around, we will hear about the landlord in the future.

      In all fairness, give them time to find a new location. After all these years of paying rent you would think it would count for something. Shame on the landlords.

      Good..fight the good fight. We have enough condos in this city. Why dont they put these crappy condos in spaces that arent already occupied? There is a ton of empty space in Toronto. This tear down everything madness has got to end.

      Read your lease. Does it say that the landlord is required to give longer notice... if not, tough luck. Read contracts before signing them. Caveat emptor.

      they are being "evicted" because they dont have a lease and the landlord gave them the required notice to vacate. and they havent.. they believe that they are above the law... is that because they are "nice"?

      I feel for this couple and have been reading the goings on with the eviction. It's a new owner of the Building and he wants them out, plain and simple.....but wait, there's more. Ed & Lily didn't have a lease with the old owner, they wouldn't sign one because they thought "we've been here for ever, my sign a lease"? If they had it would have been a different story, I feel for them but sometimes we're the masters of our own destiny. Hope it works out in the end, but the new owner spend a pile of cash and he can do what he wants with his building if there are no legal (leases in place) requirements saying otherwise.
