Murder charge reinstated against Creba suspect

TORONTO (CBC) - A young man charged in connection with the killing of 15-year-old Jane Creba in 2005 will once again face a murder charge.

The suspect was originally charged with second-degree murder, but a judge changed the charge to manslaughter. On Monday, the Ontario Court of Appeal overturned the earlier decision and reinstated the second-degree murder charge.

The suspect was 17 at the time of the 2005 Boxing Day shooting on Yonge Street which killed Creba. He also faces six attempted murder charges.

The ruling also brings into question charges against two 21 year olds accused in the shooting. The two also had second-degree murder charges reduced to manslaughter earlier this year.

The attorney general's office is appealing that decision, as well.

Creba was killed when she was caught in the crossfire during an apparent gunfight between rival gangs on Yonge Street.

Before Monday's ruling, only one alleged participant of the gun battle faced murder charges. Four others are charged with manslaughter.
