Former Spitfire Ben Johnson to be sentenced Tuesday

Former Windsor Spitfire Ben Johnson faces a sentencing hearing Monday morning.

Johnson was found guilty last month of sexually assaulting a 16 year-old girl three years ago at a downtown nightclub.

There has been a lot of online support for Johnson on social media. Several people are writing letters of support which may be taken into account by the judge during sentencing.

"The judge takes into account a number of factors," said Maria Carroccia, the president of the Criminal Lawyers Association of Essex County.

"There are factors enunciated in the criminal code that he must take into account. Generally, the judge will take into account any letters of support that might be filed on the accused behalf," she said.

Carroccia said judges will also consider victim impact statements and what the law says an appropriate sentence is in this case

Johnson's celebrity shouldn't be a factor, she said.

"The judges really do stay unbiased about that. It shouldn't really play a part. He shouldn't be favoured because of that nor should he be punished because of that fact," she said.

Johnson has been out on bail since he was found guilty last month. He is to appear in court at 10 a.m. Monday.
