New drunk driving trial this week for Michael Schmidt
A case of an Alaska Highway crash that permanently paralyzed one of the passengers is back in Yukon Supreme Court this week.
Michael Schmidt is getting a new trial on charges he was driving impaired when the crash happened Dec.14, 2009.
Schmidt was originally found guilty in 2011 of impaired driving causing bodily harm, but not guilty of having a blood-alcohol level over the legal driving limit.
One of the passengers, Jessica Frotten, has spinal injuries and has lost the use of her legs.
Schmidt appealed the conviction and won a new trial after the court of appeal found the Yukon judge made unreasonable assumptions in his analysis.
A deputy judge from outside the Yukon is hearing the case.
