Mohammad Younus found guilty of dangerous driving causing death

Mohammad Younus has been found guilty of dangerous driving causing death and dangerous driving causing bodily harm in a July 2013 crash on Highway 101 near Falmouth, N.S., that led to the death of a six-year-old boy.

Younus, who lives in Montreal, was driving a tractor-trailer when it skidded into the back of the minivan and a motorhome towing a car.

Evan Servaes was travelling in the minivan with a neighbour's family on July 9, 2013. The minivan had stopped at a construction zone when it was hit.

Servaes and another child were airlifted to the IWK Health Centre. Servaes died the next day, on his sixth birthday

In Windsor provincial court Friday, Judge Claudine MacDonald said Younus's driving was more than a momentary lapse of attention.

MacDonald said evidence showed his speed increased eight seconds before the collision and he was travelling at 104.7 km/h in the 90 km/h zone.

"Mr. Younus's dangerous driving consisted of several seconds of inattention over several hundred metres," MacDonald said.

"Furthermore, brakes were not applied until two seconds before the collision. Mr. Younus's driving conduct was dangerous to the public. A reasonable person would have driven at a speed that would allow them to stop safely."

Younus will be back in court Feb. 16 for sentencing.
