Ruth Burger, convicted in Costco crash that killed 2, appeals verdict

Ruth Burger, the woman who backed her car into the entrance of a London, Ont. Costco store and killed two children, is appealing her conviction for dangerous driving.

According to the London Free Press, the 66-year-old Burger is asking the Ontario Court of Appeal to acquit her of all charges or order a new trial.

Burger pleaded not guilty, but was convicted last summer.

Burger testified that her foot became stuck under the pedals on July 25, 2014 and that when she tried to wiggle it free, she kept pressing the gas pedal.

But the judge rejected her explanation and convicted her on 4 counts of dangerous driving. A Toronto law firm is handling the appeal, arguing the judge erred in his analysis of the case.

Six-year-old Addison Hall died in hospital after being struck. Hall's mother, Danah McKinnon-Bozek and her three-year-old daughter Miah survived the crash. But McKinnon-Bozek, who was eight months pregnant at the time, lost her infant Rhiannon, who died after being delivered by C-section.

Last month, Burger was given a suspended sentence with 3 years probation and a 5-year ban on driving.
