St. John's, province fined $60K each in July 2011 fatal ORR accident

The Newfoundland and Labrador Department of Transportation and Works and the City of St. John's have been fined $60,000 each in relation to the death of a government inspector on the Outer Ring Road in 2011.

The province and city were found guilty in December of breaching occupational health and safety laws, leading to the death of government inspector on the highway.

The Crown had been asking for fines in excess of $100,000.

Joseph English, 51, was killed while inspecting asphalt on the highway, when a vehicle lost control and struck him and two other men.

A judge later ruled that the city and province failed to establish due diligence and had a lack of appreciation of hazards for workers on the road.

Last May, Irving Oil pleaded guilty to failing to provide proper safety instruction, proper procedures and safety education for workers.

Irving Oil was fined $13,500 and was required to give the Newfoundland and Labrador government $2,000 to help provide safety education for roadway workers.

Both the province and the city had pleaded not guilty.

A city worker and a sales representative with Irving Oil were also injured in the crash.
