Texas Supreme Court denies stay in lawsuit over February 2021 vehicle pileup

At least five people were killed and dozens were injured after a crash on I-35W northbound near downtown Fort Worth on Thursday morning, February 11, 2021. Icy roads led to a massive pile-up of vehicles, including multiple 18-wheelers as well as police and MedStar vehicles, officials said.

The lawsuit that stemmed from a deadly vehicle pileup during the 2021 winter storm must go on, according to a ruling issued Friday by the Texas Supreme Court.

The court denied a stay requested by the I-35 TEXpress toll road’s operator and the shipping company FedEx, according to online court records.

Toll road operators kept the road open despite not treating it for ice in the 44 hours preceding the crash, and another major crash had occurred on the same road hours before, according to court documents.

The toll road supervisor responsible for monitoring conditions on the road said in a video deposition that she was asleep at the time the crash occurred, according to lawyers for a victim’s family.

The trial is tentatively scheduled for January 2025.
