Walmart delivery driver performs sex act at Myrtle Beach area customer’s home, suit says
A Walmart delivery driver arrested for exposing himself in a customer’s driveway has been named in a lawsuit by the woman who witnessed his lewd act.
Alvin Ortiz, 39, was arrested in July by Horry County Police for indecent exposure. The charge is based on Ortiz’s actions at a woman’s Intracoastal Waterway home where he delivered a grocery order on July 8, 2024.
The person who filed the suit on Dec. 19, 2024, is only listed as “Jane Doe.” The suit says the woman is not using her name “due to the potential harmful impact that the public disclosure of her identity could have, and the nature of the harm inflicted by Defendants.”
Ortiz was released on July 10, 2024, from the J. Reuben Long Detention Center on a $2,500 bond.
In addition to Ortiz, the suit also names Walmart, Spark Delivery and Walmart Stores East.
Messages left with Walmart and Spark Delivery were not immediately returned.
Walmart’s app allows customers to see the progress of their order from the time it leaves the store until it is delivered. It also informed Jane Doe the name of the delivery driver who would be completing her grocery delivery, the suit said.
Ortiz delivered Jane Doe’s grocery order, which was requested to be placed at her front door upon delivery.
Ortiz delivered the grocery order that morning and was recorded on Doe’s Ring doorbell camera and through the app, notifying Doe of the delivery. Ortiz proceeded to walk down Doe’s sidewalk to his vehicle, where stayed in her driveway for 10 to 15 minutes, the suit said.
Doe decided to walk outside to investigate why Ortiz was still in her driveway. As Doe approached Ortiz’s vehicle, she saw Ortiz with his pants pulled down, masturbating in his vehicle, the suit said.
Doe ran back inside her home for safety and called her male neighbor who lived across the street for help. The neighbor walked to Ortiz’s vehicle “to confront him,” and Ortiz rushed to pull up his pants and a verbal altercation ensued between Ortiz and the neighbor, the suit said.
Ortiz then fled the scene, yelling out of his window that “he was going to come back to ‘F’ everyone up,” the suit said.
Doe contacted police who were able to get Ortiz’s information from Walmart East. He was later arrested on July 9, 2024, the suit said.
The suit claims the defendants were negligent in hiring Ortiz, alleging that Ortiz was hired by Walmart East for its delivery service without doing a background check.
Walmart and Walmart East “owe a duty to its consumers” to make sure that their delivery drivers “will not commit improper conduct while on the job,” the suit said.
By failing to investigate and screen Ortiz appropriately, he was entrusted with private, consumer information, the suit said.
Jane Doe is seeking a jury trial.
