Woman Sues Dead Husband For £5m Over Car Crash That Killed Him And Injured Her

A mum-of-two is suing her dead husband for millions of pounds over the car crash that killed him and left her fighting for her life.

Christina Vibert claims that the crash has left her unable to look after her children properly and is seeking compensation from husband Ross Graham - despite him being killed in the accident.

Graham is said to have been high on cannabis when his Honda CRX smashed into an HGV trailer on a roundabout in Wester Hailes, Edinburgh, in January 2013.

Christina was in a coma for two months after the crash and can only now manage to walk short distances with a walking stick.

The 29-year-old also suffers from concentration problems and struggles to communicate effectively.

Compensation: Christina claims her husband’s actions have stopped her from being able to care for her children (Facebook)

Her claim states: “She required and for the remainder of her life will require assistance with the normal activities of daily living.

"She has lost the companionship and society of her children, which greatly distresses her.”

Graham’s insurers, Zenith, have refused to accept liability for a payout, blaming Christina for being in the vehicle in the first place.

A spokesman said: “The pursuer (Ms Vibert) ought not to have allowed herself to be a passenger in the vehicle being driven by the deceased whilst he was under the influence of cannabis.

"Had she not allowed herself to be a passenger all her injuries would have been avoided.”

Christina insists she does not remember her husband using cannabis.

The case will resume later.
