Appeals court extends sentence for woman who had sex with boy, 12

A Newfoundland woman has been sentenced to an extra year in jail for having sex with a 12-year-old boy, after the appeals court ruled she should spend more time behind bars.

The woman, who was 23 at the time, cannot be named due to a publication ban protecting the child. She was convicted in April 2014 of sexual assault and sexual interference.

For those crimes, the trial judge sentenced the woman to one year for each charge to be served concurrently, followed by two years of probation.

The mother of two exchanged text messages with the boy, who was her neighbour, during the summer of 2011.

Boy believed he was in romantic relationship

The woman fondled the boy and had sex with him on two separate occasions.

It reached a breaking point in October 2011, when the boy's parents discovered that he had packed his bags, and had been planning to move in with the woman.

The boy, who told the court during trial he didn't want to get the woman in trouble, had thought he and the woman were in a romantic relationship.

His mother urged the woman to stop contacting her son, but she did not. The boy's parents then reported the matter to police.

For her actions, the Crown appealed the sexual assault sentence and the 20-year sex offender registry order.

The Crown argued that one year in jail for having sex with a boy on two occasions was "unfit" and recommended that the woman be on the sex offender registry for life.

The Newfoundland and Labrador Court of Appeal agreed.

Her sentence has been doubled and will be on a lifetime registry.
