Nine businesses in Wichita, Cheney and Derby — including restaurants, stores and a hotel — were out of compliance during food safety and lodging inspections conducted by the Kansas Department of Agriculture last week.
They were cited over dented cans and “unidentified food” on sales shelves, no water at sinks, a roach in a kitchen, a pitcher of soy sauce that was stored with chemicals, ants crawling on food pumps containing caramel and chocolate sauces, foods left out at room temperature that were supposed to be refrigerated, bottles of chemicals that weren’t labeled, a cross-contamination risk from allowing customers to crack their own raw eggs and more, according to inspection reports.
Information about the food establishments and a summary of their violations appear below. The list includes inspections conducted in Sedgwick County from April 28 to May 4. It was compiled on May 8.
More than 60 establishments passed inspections during that same time. They also appear below. Some may have been non-compliant in previous weeks.

Out-of-compliance inspections
Best Western Governors Inn & Suites, 4742 S. Emporia in Wichita — Six violations on May 2 during a routine inspection. A plastic container was stored in a kitchen sink that is supposed to be used for hand-washing only, spray bottles weren’t labeled with contents, no paper towels at kitchen hand-washing sink, milk wasn’t cold enough in refrigerator, no ambient air thermometer inside of a cooler, no sanitizer testing strips on site. Next inspection: May 12.
Family Dollar, 1330 N. Oliver in Wichita — Three violations on April 30 during a routine inspection. Dented cans of tomato sauce and tortilla soup, a “can of unidentified food” stored alongside tuna, no hot water anywhere in the store. Next inspection: May 11.
Jack’s North Hi Donuts, 603 W. 13th St. in Wichita — Four violations on May 2 during a routine inspection. The restaurant didn’t have a consumer advisory that discloses the risk of eating raw or undercooked foods even though it was offering raw eggs for ramen, no probe food thermometer for monitoring cooking and food temperatures, raw eggs stored above doughnut fillings, restaurant was letting customers crack their own raw eggs to top ramen even though that poses a risk of cross contamination. Next inspection: May 12.
Marchello’s, 3107 S. Seneca in Wichita — Three violations on April 30 during a routine inspection. A frozen bag of shrimp was thawing in a sink dedicated to hand-washing, pans of sausage and ravioli and chicken weren’t labeled with preparation dates, no water at kitchen hand-washing sink. Next inspection: May 10.
Ninza Sushi East, 306 N. Rock Road, Suite 20 in Wichita — Six violations on April 29 during a routine inspection. Frozen takoyaki balls were thawing at room temperature, several containers of foods including crab cakes and soft shell crab weren’t cooling properly because a compressor was frozen over, noodles weren’t cold enough in a refrigerated preparation table, a pitcher of soy sauce was stored with chemicals, a pitcher of green liquid wasn’t labeled with its common name, containers of acidified sushi rice and fried tempura shrimp weren’t labeled with their discard times. Next inspection: May 10.
Passage to India, 6100 E. 21st St., Suite 180 in Wichita — Three violations on April 30 during a follow-up inspection. Pans of cooked cauliflower and fried vegetables weren’t labeled with preparation dates, dried food debris on a vegetable dicer, “live adult roach crawled from under the prep table” in the kitchen. Next inspection: May 10.
Sonic Drive-In, 107 N. Rock Road in Derby — Two violations on May 2 during a complaint inspection. Ants were crawling on a table that holds tea and lemonade and dessert sauces and on food pumps holding the sauces, sliced tomatoes weren’t cold enough in a make table. Next inspection: May 12.
SPK Grocery, 412 N. Main in Cheney — Four violations on May 3 during an inspection that was a follow-up to an administrative order. Labeling issue with sliced deli meats, no hot water at hand-washing sink in the produce area, the grocery store didn’t have the correct test strips for the type of sanitizer it uses, a container of sanitizer was sitting on a cutting board in the meat room next to packages of deli meat. Next inspection: July 3.
Wasabi East, 3242 N. Rock Road, Suite 112 in Wichita — Seven violations on April 30 during a routine inspection. Bottles of sanitizer and window cleaner weren’t labeled, no soap at kitchen hand-washing sink, logs tracking the time rice was removed from temperature control weren’t filled out, sushi rice was being used beyond its discard time, the restaurant didn’t have written procedures immediately available for the inspector detailing how it handles sushi rice, a container of potato crunch was left out at room temperature, no paper towels at kitchen hand-washing sink. Next inspection: May 10.

How businesses fail inspections
Most violations are minor and are corrected during an inspection.
Businesses fall out of compliance when they have too many violations, issues that can cause foodborne illnesses or when a problem can’t be fixed right away, such as bug and rodent infestations. Typically, establishments are re-inspected within 10 days.
It’s rare for a facility to shut down over a failed inspection. But it can happen due to things like sewage backups, pest problems, and water or power outages. Usually, closures are temporary.
