Nobody held responsible for pulling trigger in fatal Calgary shooting as third plea deal made

The third and final person charged in connection with the drug-related shooting death of Tyler Sanderson has pleaded guilty ahead of trial and nobody has ever admitted to or been held accountable for pulling the trigger.

Lori Heavenfire was originally charged with second-degree murder but has pleaded guilty to accessory after the fact to manslaughter with a firearm.

A joint submission for a one-year sentence was proposed by prosecutors Kyra Kondro and Gianna Argento along with defence lawyers Kim Arial and Dale Fedorchuk.

With credit for the time she'd already served, Heavenfire will spend no more time behind bars.

Tyler Sanderson was shot in the chest on May 15, 2016, while in the backseat of Heavenfire's car, outside his home in the northeast community of Marlborough Park.

Afterward, Sanderson stumbled to the back steps of his house and collapsed.

Sanderson's mother and girlfriend found the injured man and tried unsuccessfully to save him but he died at Foothills hospital shortly after.

2 others plead guilty

At the time of Sanderson's death, police said the Calgary man was killed during a drug deal gone wrong.

In the hours before he was killed, Heavenfire was hanging out with Dylan Calf and Justin Cecil Scott at her home on the Tsuut'ina Nation Reserve.

The trio then drove into Calgary, where they had contact with Sanderson.

Prosecutors could not prove "that [Heavenfire] was aware of a plan to injure Mr. Sanderson, participation of the infliction of the injuries or that a weapon was present," according to the agreed statement of facts read aloud on Monday.

In May 2017, Calf, who had also been charged originally with second-degree murder, pleaded guilty to robbery.

Scott was originally charged with second-degree murder but pleaded guilty to the lesser offence of accessory after the fact to manslaughter.
