Assault charges against David Milgaard withdrawn

Charges that stemmed from a fight between David Milgaard and his wife were withdrawn Monday in a Calgary courtroom.

Milgaard is best known for spending almost 23 years in jail for a murder he did not commit.

Last month, he was accused of assault, assault with a weapon, and uttering threats following a fight with his wife, Cristina, on Oct. 26. He was arrested and spent several hours in custody before being released on his own recognizance.

The judge who dropped the charges Monday ordered Milgaard, 59, to get counselling and pay a $3,000 peace bond.

Court had heard the couple were arguing over their son when Milgaard threatened his wife with a knife.

After his arrest, the couple, who are raising two young children in Calgary, indicated they were anxious to reconcile.

Milgaard's time in prison for the 1969 murder of Gail Miller in Saskatoon ended after the Supreme Court of Canada set aside his conviction. He was released in 1992.

Five years later, in 1997, he was exonerated by DNA evidence and in 1999 he received $10 million from the federal and Saskatchewan governments.Convicted rapist Larry Fisher was found guilty of Miller's murder that same year.
