Collin County judge dismisses lawsuit against Dallas Cowboys quarterback Dak Prescott

A Collin County judge dismissed on Wednesday a sexual assault lawsuit filed against Dallas Cowboys quarterback Dak Prescott and scheduled a hearing to determine if there should be sanctions against his accuser.

Victoria Shores of Fort Worth filed the lawsuit seeking $1 million in damages. She had accused Prescott of sexually assaulting her in the parking lot of a Dallas strip club in 2017 and demanded compensation for past and future medical expenses, pain and mental suffering.

The woman filed a police report on March 12 about an alleged incident that occurred on Feb. 2, 2017, in the parking lot of XTC Cabaret in the 8500 block of Stemmons Freeway. In response, Prescott filed a civil lawsuit a week later in Collin County against Shores and her attorneys, alleging extortion. He said they had asked for $100 million to not report the allegations to police.

Dallas police said in May that they closed the case and would not pursue criminal charges against Prescott, citing a lack of evidence that a crime was committed.

Judge Angela Tucker said the lawsuit lacked merit and the woman’s claims of sexual assault and defamation were unfounded, according to KTVT-TV.

“The original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak,” Prescott’s attorney, Levi G. McCathern, said in a statement to Star-Telegram media partner WFAA-TV. “These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them.”

The sanctions hearing is scheduled for 1:30 p.m. Sept. 13.
